By accessing or using the CreatorMoment website and services (collectively, "CreatorMoment"), you agree to be bound by these Terms of Service ("Terms"), which may be updated as described in the "Changes to Terms" section. If you do not agree to these Terms, you must not access or use CreatorMoment. Your use is also subject to our Privacy Policy.

CreatorMoment is a creator discovery platform that connects emerging streamers and content creators with established host creators through live Discovery Reels. Creators can apply for paid or free placement slots in hosted showcase segments, where audiences vote on featured clips and top performers may receive live raids.

1. Service Description: Hawkins Business Architecture Pty Ltd, as operator of CreatorMoment, facilitates paid media placements ("Slots") for creators to be featured in content produced by third-party hosts ("Host Creators").

2. No Guarantee of Results: While we guarantee that your content will be featured if your application is accepted and paid for, CreatorMoment makes no representation or warranty regarding the number of views, followers, or clicks you will receive. Performance depends on audience reception.

3. Voting Mechanics & Raid Eligibility: CreatorMoment utilises a Split-Voting System to determine outcomes:

• Global Leaderboard: Calculated by total aggregate votes from all sources. This is a visibility metric only.
• Raid Winner: Determined EXCLUSIVELY by votes tracked via the Host's unique referral link ("Verified Host Audience").

You acknowledge and agree that having the highest total vote count does not entitle you to the Live Raid if you do not win the Verified Host Audience vote. Votes accumulated through external community sharing or "brigading" will not count toward the Raid prize.

4. Host Discretion: The Host retains final discretion regarding the Raid target for reasons of brand safety, technical stability, or timing.

5. Refunds: Payments are non-refundable once the Host has successfully aired the segment featuring your content. If a Host fails to perform the segment, you are entitled to a full refund or a rescheduled slot.

6. Content Standards: You warrant that any clip submitted for placement is your original work and does not violate the Terms of Service of the hosting platform (YouTube/Twitch/TikTok/Instagram). We reserve the right to reject any submission that poses a brand safety risk, with a full refund issued for rejected applications.

CreatorMoment offers optional OAuth-based identity verification via Twitch, Kick, YouTube, and TikTok. By connecting a platform account you:

• Confirm that the account belongs to you and that you have the right to authorise access.
• Acknowledge that we will record a timestamped, immutable verification event (platform user ID, username, IP address, and browser details) as an audit trail for fraud prevention and identity assurance.
• Grant us permission to display your verified platform identity on CreatorMoment and, where applicable, on our affiliated B2B platform CreatorRegister.
• Understand that we do not post, publish, or take any action on the connected platform on your behalf.

You may disconnect a platform at any time via that platform's own settings. Disconnection does not delete the verification audit record already created. If you believe a verification was made in error or fraudulently, contact us at [email protected] immediately.

All content on CreatorMoment, including text, graphics, logos, and software, is owned by FameForecast Pty Ltd or its licensors and protected by copyright, trademark, and other intellectual property laws. The platform is operated by Hawkins Business Architecture Pty Ltd under exclusive license.

User Content: By submitting content (clip URLs, bios, images) as part of an application, you grant Hawkins Business Architecture Pty Ltd a worldwide, non-exclusive, royalty-free license to use, display, and distribute it within the platform for the purposes of the agreed service.

Reporting Concerns: If you believe content infringes your intellectual property rights, contact us at [email protected].

You agree to use CreatorMoment lawfully and not to:

• Violate any applicable laws or regulations.
• Submit clips or content that violates the Terms of Service of the original hosting platform.
• Impersonate others, including CreatorMoment staff, hosts, or other creators.
• Harass, defame, or harm others.
• Attempt to manipulate voting outcomes (e.g., using bot accounts or vote brigading).
• Introduce malicious code or use automated tools to scrape or manipulate data.

Violations may result in removal from a showcase, forfeiture of your placement fee, or a ban from future applications, at our sole discretion.

CreatorMoment is provided "as is" and "as available." We do not warrant uninterrupted or error-free access, and we make no guarantees about audience growth, raid outcomes, or discovery results from participation in any showcase.

To the fullest extent permitted by Australian law, Hawkins Business Architecture Pty Ltd (as operator of CreatorMoment), its affiliates, and licensors are not liable for any direct, indirect, or consequential damages arising from your use of CreatorMoment. Our total liability shall not exceed the amount you paid for the relevant placement, unless required by law, including the Australian Consumer Law.

We may update these Terms at our discretion, effective immediately upon posting. Continued use after updates constitutes acceptance. Please review periodically.

These Terms are governed by the laws of the State of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia for the resolution of any disputes.
